2. The state information system is created in order to ensure, through the use of information and communication technologies, the fulfillment of duties, the exercise of rights and interaction in electronic form in the exercise of state control (supervision) and municipal control by officials of bodies authorized to exercise state control (supervision), municipal control (hereinafter, respectively - state control (supervision) bodies, municipal control bodies).

3. The task of creating a state information system is to automate the processes:

a) application of a risk-based approach in the implementation of state control (supervision);

b) assessing the effectiveness and efficiency of state control (supervision) and municipal control;

c) systematization and accounting of the requirements established by the Federal Law "On the Protection of the Rights legal entities and individual entrepreneurs in the exercise of state control (supervision) and municipal control", other federal laws and regulatory legal acts adopted in accordance with them, laws and regulatory legal acts of the constituent entities of the Russian Federation, municipal legal acts;

d) information interaction between state control (supervision) bodies, municipal control bodies, prosecution authorities, other state bodies, as well as organizations, including within the framework of state control (supervision) and municipal control measures, including by providing access to information on the activities of legal entities and individual entrepreneurs subject to state control (supervision) or municipal control, and on the production facilities used by them, including through the use of special technical means, including automatic means measuring and recording the volume or mass of pollutant emissions, pollutant discharges, pollutant concentrations, as well as technical means of recording and transmitting information;

e) carrying out measures for the implementation of state control (supervision) and municipal control.

4. The principles of functioning of the state information system are:

a) providing access to the services of the state information system, carried out using the information and telecommunications network "Internet" and involving the possibility of individualized configuration of the processes and information resources of the state information system;

c) information interaction of the state information system with other state information systems carried out through a unified system of interdepartmental electronic interaction;

d) formation, maintenance and updating of classifiers and directories used in the state information system, carried out using the federal state information system "Unified System of Regulatory Reference Information".

5. Participants of the state information system are:

a) the operator of the state information system - the Ministry of Telecom and Mass Communications of the Russian Federation (hereinafter referred to as the operator);

b) coordinators of the state information system - persons replacing the positions of the federal state civil service, the state civil service of the constituent entities of the Russian Federation or the municipal service, who are appointed by the relevant acts of the federal executive authorities exercising the functions of state control (supervision), the highest executive authorities of the constituent entities of the Russian Federation Federations or local governments (hereinafter referred to as coordinators);

c) authorized persons of the state information system - persons replacing the positions of the federal state civil service, the state civil service of the constituent entities of the Russian Federation or the municipal service, included in the relevant legal acts of the federal executive authorities exercising the functions of state control (supervision), the highest executive authorities of the subjects of the Russian Federation or local self-government bodies to the appropriate list of officials (hereinafter referred to as authorized persons);

d) users of the state information system - persons who have the authority to organize or carry out measures for state control (supervision) and municipal control and fill positions in the federal state civil service, state civil service of the constituent entities of the Russian Federation or municipal service, as well as persons who are employees of state or municipal budgetary institutions and having the authority to organize or conduct control measures without interacting with legal entities, individual entrepreneurs, registered by authorized persons in the state information system in accordance with the legal acts of federal executive bodies exercising functions of state control (supervision), higher executive authorities of the constituent entities of the Russian Federation or local governments (hereinafter referred to as users).

6. The operator provides:

a) organization of the technical functioning of the state information system;

b) creating, maintaining and maintaining up-to-date forms for presenting information contained in information resources the state information system, including elements of forms, including fields, names and details, to the extent necessary for use by participants in the state information system;

c) creation, maintenance and up-to-date maintenance of directories and classifiers to the extent necessary for use by all participants in the state information system;

d) development of technical means, software and telecommunications infrastructure that ensure the functioning of the state information system;

e) checking the interaction of the state information system with other state information systems in terms of controlled performance parameters;

f) compliance information security, including the protection of data placed in the information resources of the state information system;

g) information interaction of the state information system with other state information systems, preparation and conclusion of agreements on the provision of services for the implementation of interdepartmental information interaction in order to obtain information, the content and volume of which are necessary for the implementation of the powers vested in state control (supervision) bodies and municipal authorities control by normative legal acts;

h) connection to the state information system of federal executive authorities, executive authorities of the constituent entities of the Russian Federation and local governments and use of the state information system on the basis of cooperation agreements concluded by the operator;

i) registration, access to information resources of the state information system, methodological, informational and technical support for coordinators and authorized persons.

7. The operator claims:

a) rules for the use of the state information system, including the use electronic signature operator for the purpose of signing requests within the framework of interdepartmental information exchange;

b) requirements for methodological, informational and technical support, registration of participants in the state information system, as well as providing access to information resources of the state information system;

c) standard forms of cooperation agreements concluded in the case provided for by this Regulation.

8. The powers of the coordinators are approved within the framework of the rules for using the state information system and include:

a) a list of authorized persons;

b) the regulations and form of interaction between authorized persons and the operator, including on issues of operating the state information system, providing the operator with information about authorized persons, ensuring access and determining the scope of access rights of authorized persons to information resources of the state information system;

c) regulations for coordinating the activities of authorized persons;

d) the procedure and form for collecting, summarizing and analyzing information on the efficiency and effectiveness of the activities of the federal executive body or the government body of a constituent entity of the Russian Federation using the state information system.

9. The rights and obligations of authorized persons are approved within the framework of the rules for using the state information system and include, among other things, interaction with the operator in the implementation of the following procedures:

a) user registration;

b) provision technical support registered users when working in the state information system;

c) formation of requests for technical support to be sent to the operator;

d) ensuring the adjustment of the state information system, including the adjustment of standard processes;

e) verification of the state information system for controlled performance parameters;

b) planning activities for the implementation of state control (supervision) and municipal control, taking into account the assigned risk categories and hazard classes, the formation of draft annual plans for scheduled inspections of legal entities (their branches, representative offices, separate structural divisions) and individual entrepreneurs in an automated mode, in including using information about the assigned risk categories and hazard classes, ensuring intradepartmental coordination of draft action plans for the implementation of state control (supervision) and municipal control, transfer of draft action plans for the implementation of state control (supervision) and municipal control to the federal state information system unified check register;

c) ensuring the possibility of using and maintaining checklists (lists of control questions) approved by legal acts of state control (supervision) bodies and municipal control bodies;

d) entering information on measures for the implementation of state control (supervision), municipal control in the federal state information system, a unified register of inspections through Personal Area a user signing the information entered with the electronic signature of the user who entered it;

e) sending requests and obtaining information about the person being checked within the framework of interdepartmental information interaction;

k) providing access to electronic services state information systems that provide information necessary for the implementation of the functions of state control (supervision) and municipal control, connected to a unified system of interdepartmental electronic interaction;

l) ensuring the protection of transmitted information from unauthorized access, distortion or blocking from the moment of receipt specified information into the state information system and until the moment of its transfer to single system interdepartmental electronic interaction or user;

m) formation, maintenance and publication for public access in the information and telecommunication network "Internet" for each type of state control (supervision), municipal control of lists of regulatory legal acts or their separate parts containing the requirements specified in this Regulation, the assessment of compliance with which is the subject of state control (supervision) or municipal control, as well as the texts of the relevant regulatory legal acts;

o) processing in machine-readable form information about the values ​​of indicators of activities for the implementation of state control (supervision) and municipal control corresponding to the standard list of indicators of the effectiveness and efficiency of control (supervisory) activities and the structure of the list of indicators of the effectiveness and efficiency of control (supervisory) activities;

o) transfer of information about the values ​​of indicators of performance and efficiency of activities for the implementation of state control (supervision) and municipal control to the state automated information system "Management".

12. Technical and software means of the state information system provide:

a) protection of information contained in information resources, including from copying, distribution, destruction, modification and blocking access to it, as well as from other illegal actions;

b) the use of an enhanced qualified electronic signature when placing, changing or deleting information, as well as the possibility of verifying such an electronic signature throughout the entire period of storage of information by means of the state information system;

d) maintaining electronic logs of transactions performed with the help of technical and software tools, allowing to ensure accounting of all actions for placing, changing and deleting information, fixing the exact time, the content of the changes and information about the persons who made the changes;

e) daily copying of information and electronic journals of operations on a backup material carrier, providing the possibility of restoring the specified information;

f) storage backups information and electronic logs of transactions received as a result of daily copying for 30 calendar days.

13. The use of the state information system by state control (supervision) bodies and municipal control bodies for the purpose of exercising state control (supervision) and municipal control is carried out on the basis of agreements concluded in accordance with this Regulation.

14. In the presence (creation) in the state control (supervision) body and the municipal control body of departmental information systems for automating control (supervisory) activities that ensure the automation of the processes and other processes specified in this Regulation, the decision to use the state information system may be made by these bodies independently .

1. This Regulation defines the goals and main tasks of creation, principles of operation, functions of the state information system "Typical cloud solution for automation of control and supervision activities" (hereinafter - GIS TOR CND), participants of GIS TOR CND and their powers.

2. GIS TOR KND is created in order to ensure, through the use of information and communication technologies, the fulfillment of duties, the exercise of rights and interaction in electronic form in the exercise of state control (supervision), municipal control by officials of bodies authorized to exercise state control (supervision), municipal control (hereinafter, respectively - state control (supervision) bodies, municipal control bodies).

3. The main task of creating a GIS TOR KND is to automate the processes:

a) application of a risk-based approach in the implementation of state control (supervision);

b) assessing the effectiveness and efficiency of state control (supervision), municipal control;

4. Principles of functioning of GIS TOR KND:

5. Participants of GIS TOR KND are:

GIS operator TOR KND;

GIS TOR KND coordinators in federal executive authorities, GIS TOR KND coordinators in the constituent entities of the Russian Federation (hereinafter referred to as GIS TOR KND coordinators);

Authorized persons of federal executive authorities, executive authorities of the constituent entities of the Russian Federation for interaction with the GIS TOR KND operator, coordinators of the GIS TOR KND (hereinafter referred to as authorized persons of the GIS TOR KND);

Authorized officials of state control (supervision) bodies, municipal control bodies, other state bodies (hereinafter referred to as users of the GIS TOR KND).

6. The operator of the GIS TOR KND is the Ministry of Telecom and Mass Communications of the Russian Federation.

GIS TOR KND operator:

a) organizes the technical functioning of the GIS TOR KND, develops the software and hardware of the GIS TOR KND and the telecommunications infrastructure of the GIS TOR KND;

b) determines the composition and structure of information to be placed in the information resources of the GIS TOR KND, the formation, maintenance and updating of classifiers and directories of the GIS TOR KND in terms of information required to be entered into the GIS TOR KND by all participants;

c) determines the procedure for methodological, informational and technical support for participants in the GIS TOR KND, the procedure for ensuring information security of the GIS TOR KND, the procedure for registering participants and accessing the GIS TOR KND, the procedure for information interaction of the GIS TOR KND with information systems, the procedure for verifying the GIS TOR KND for controlled speed parameters and requirements of GIS TOR KND, the procedure for preparing and accepting agreements on the provision of services of GIS TOR KND (hereinafter referred to as the procedures determined by the operator of GIS TOR KND);

f) ensures compliance with the information security requirements of the GIS TOR KND, including the protection of personal data posted in the GIS TOR KND;

g) ensures the registration of authorized persons of the GIS TOR KND, access of authorized persons of the GIS TOR KND to the GIS TOR KND in terms of assigning an identifier (code) to federal executive authorities, executive authorities of the constituent entities of the Russian Federation, using which they are identified and authenticated.

7. The coordinators of the GIS TOR KND are officials of federal executive authorities, executive authorities of the constituent entities of the Russian Federation, whose powers to participate in the GIS TOR KND are fixed by legal acts of the heads of federal executive authorities, senior officials of the constituent entities of the Russian Federation (heads of the highest executive bodies of state the authorities of the constituent entities of the Russian Federation (hereinafter referred to as the coordinators of the GIS TOR KND).

GIS TOR KND coordinators:

a) approve the composition of authorized persons of the GIS TOR KND;

c) interact with the operator of the GIS TOR KND on issues of ensuring access of authorized persons of the GIS TOR KND to the GIS TOR KND and providing information on the composition of authorized persons of the GIS TOR KND.

8. Authorized persons of GIS TOR KND:

a) carry out the procedure for registering officials of state control (supervision) bodies, municipal control bodies in the GIS TOR KND;

b) provide officials of state control (supervision) and municipal control bodies registered in the GIS TOR KND with automated workstations, means of encrypting the main data transmission channels, means of authorized access to the GIS TOR KND, including means of electronic signature, within the established maximum number of employees , as well as budget allocations provided by this body of state control (supervision), the municipal control body in the federal budget, the budgets of the constituent entities of the Russian Federation and the local budget for the corresponding year and planning period for leadership and management in the field of established functions;

c) provide technical support to officials of state control (supervision) bodies, municipal control bodies that are users of the GIS TOR KND;

d) form requests to the technical support service, carried out by the operator of the GIS TOR KND;

e) provide system settings for the work of state control (supervision) bodies, municipal control bodies of a constituent entity of the Russian Federation, including setting up standard processes and information resources;

f) check the GIS TOR KND according to the controlled performance parameters and the requirements of the GIS TOR KND;

g) carry out the formation of additional information resources of the GIS TOR KND, their use in the framework of state control (supervision), municipal control;

h) determine the composition and structure of information to be placed in the information resources of the GIS TOR KND, the formation, maintenance and updating of classifiers and directories of the GIS TOR KND in terms of information used in the exercise of the powers of the relevant federal executive body, executive body of the constituent entity of the Russian Federation, body of local government.

9. Authorized persons of state control (supervision) bodies, municipal control bodies of a constituent entity of the Russian Federation:

a) use the GIS TOR KND on the basis of subparagraphs "a" - "j" of paragraph 10 of these Regulations in accordance with the procedures determined by the operator of the GIS TOR KND.

10. The functions of the GIS TOR KND are to provide:

a) maintaining a register of inspected subjects and objects with the possibility of entering into the register of inspected subjects and objects information about the risk categories assigned to the inspected persons, objects, hazard classes;

b) planning activities for the implementation of state control (supervision), municipal control, taking into account the assigned risk categories, hazard classes (formation of draft annual plans for scheduled inspections of legal entities (their branches, representative offices, separate structural divisions) and individual entrepreneurs (hereinafter - draft plans ) in an automated mode using information from the register of inspected subjects and objects, including information about the assigned risk categories, hazard classes, intradepartmental approval of draft action plans for the implementation of state control (supervision), municipal control, transfer of draft action plans for the implementation of state control (supervision), municipal control into the federal state information system of the unified register of inspections (hereinafter - FSIS ERP);

c) recording (inputting, saving, using) in machine-readable form information about the values ​​of indicators of activities for the implementation of state control (supervision), municipal control, corresponding to the standard structure and the list of indicators of the effectiveness and efficiency of activities for the implementation of state control (supervision), municipal control, established by the Government of the Russian Federation;

11. Technical and software tools of GIS TOR KND provide:

a) protection of information contained in the GIS TOR KND in accordance with the legislation in the field of information protection, including from copying, distribution, destruction, modification and blocking access to it, as well as from other illegal actions;

b) the use of an enhanced qualified electronic signature or other electronic signature in cases established by the legislation of the Russian Federation, when placing, changing or deleting information, as well as ensuring the possibility of verifying an electronic signature throughout the entire period of information storage;

d) maintaining electronic logs of operations performed using hardware and software tools that allow accounting for all actions for placing, changing and deleting information, fixing the exact time, content of changes and information about the persons who made the changes;

e) daily copying of information and electronic journals of operations on a backup material medium, which ensures the possibility of their recovery;

f) storage of backup copies of information and electronic journals of transactions received as a result of daily copying for 30 calendar days.
